Landlord Gas Safety Checks in Birmingham: What You Need to Know
If you rent out a property with gas appliances, gas safety is an ongoing legal responsibility rather than something to arrange only when a tenancy changes.
Heatline is based near Sutton Coldfield Town Centre and works with landlords across Sutton Coldfield, including properties around The Parade and High Street, near Good Hope Hospital on Rectory Road, and in areas such as Boldmere, Four Oaks, Mere Green, Walmley and Wylde Green.
The Health and Safety Executive (HSE) states that landlords must arrange an annual gas safety check on gas appliances and flues they own and provide for tenants, using a Gas Safe registered engineer.
How often is a landlord gas safety check required?
HSE guidance says the gas safety check must be carried out every year. Before a new tenancy starts, the required checks must be current, and tenants must receive the relevant gas safety record.
There is also a permitted window that can help landlords retain an existing annual deadline when the check is completed early. If you manage several properties, keeping a consistent diary for renewal dates can make compliance easier.
What gas appliances are included?
The duty covers gas appliances and flues that the landlord owns and provides for the tenant’s use. This commonly includes gas boilers, fires and other landlord-provided gas appliances.
Where tenants own an appliance themselves, responsibilities differ, so check the current HSE guidance if the situation is unusual.
What records need to be kept?
HSE says landlords must keep the gas safety record and provide copies to tenants within the required timescales. The record includes details such as the appliance or flue checked, the property address, the date of the check, the engineer’s details and any safety defects identified.
Is a gas safety check the same as a boiler service?
No. HSE specifically warns landlords not to assume an annual safety check is automatically sufficient maintenance, or that a service automatically covers everything required by the statutory gas safety check.
That distinction is important. A safety check is about meeting the required safety checks and recording the outcome; servicing and maintenance are about keeping the appliance in proper condition according to its needs and the manufacturer’s instructions.
What if the engineer finds a defect?
If a safety issue is identified, landlords must take appropriate action. An appliance that is unsafe should not be used until the issue has been dealt with. Keep records of follow-up work so there is a clear history of what was found and what was done.
Can records be electronic?
Yes. HSE guidance allows electronic records provided they can be reproduced when required, are protected from loss or interference, and clearly identify the engineer who completed the check.
